Can I Apply for Another Student Visa While in Australia?

3 min read

You cannot assume that holding a Student visa allows you to lodge another one in Australia. Under the rules introduced on 2 October 2026, current students need an applicable exemption. Other affected temporary visa holders must apply offshore. Start with your current visa and your role on it: primary student or dependant.

Information checked on 10 October 2026. This guide focuses on application location, rather than the separate question of whether your proposed study meets every visa requirement.

The onshore exemptions to investigate

Home Affairs lists limited circumstances, including PhD or school study, DFAT or Defence sponsorship, qualifying course progression, provider default and up to twelve additional months to finish the main course with the same provider. The additional time is measured against the original course end date. Each exemption has conditions; a broad category label is not enough.

For course progression, completing the main course matters. Moving to a higher AQF level may qualify, but where the completed course is higher education, the next course must also be higher education delivered by a higher education provider. Special progression provisions also address certain school and non-AQF courses.

Why another master’s degree needs careful checking

The Australian Qualifications Framework places master’s degrees at level 9 and doctoral degrees at level 10. A different subject, university or research component does not automatically create a higher AQF level. Check the qualification itself, not the marketing description.

Illustrative example: someone completing an MBA considers a Master by Research. The academic move may make sense, but if both qualifications are AQF level 9, the student should not assume the higher-level progression exemption applies. A sound study explanation and an onshore lodgement exemption answer different questions.

What if I need more time to finish?

Collect the original course dates, current CoE, results and the provider’s explanation for the delay. Ask the institution to distinguish completion of the existing main course from enrolment in a replacement course. That distinction should be resolved before anyone calls the application an extension.

Prepare a simple chronology: visa grant, course commencement, any changes, original completion date and revised completion date. This helps an adviser identify whether the claimed exemption matches the actual history. Include failed subjects or interruptions accurately rather than leaving gaps.

Can a Student visa dependant become the primary student onshore?

Home Affairs states that a Student visa dependant seeking a Student visa as the primary applicant must lodge offshore and be offshore for grant, with no exemption to that rule. A partner’s admission to a course therefore needs its own migration assessment.

Planning an offshore application

Home Affairs explains that an offshore application does not generate a linked Bridging visa. If you return on another valid visa while the application is pending, the offshore grant requirement still needs attention. Do not assume a pending application extends your existing stay.

Build the plan backwards from visa expiry and the course start date. Discuss departure, accommodation, course deferral, work commitments and the family’s separate position. Obtain written confirmation of refund and deferral policies before paying substantial fees.

Questions to put to your adviser

  • Which exact exemption, if any, fits my current visa and course history?

  • What document proves I completed the main course?

  • What are the AQF levels of both qualifications?

  • Does my proposed provider meet the relevant higher education requirement?

  • Do visa conditions or my previous immigration history create another barrier?

  • What is the plan if I must apply offshore?

Frequently asked questions

Is a new CoE enough to apply in Australia?

A CoE is evidence about enrolment. Ask your adviser to assess application validity separately rather than treating the CoE as permission to lodge onshore.

Does paying for a consultation guarantee eligibility?

No. The value of a consultation is a reasoned assessment of the available evidence, including an explanation when the desired pathway is unavailable.

What should I do if the advice is unclear?

Request the rule relied on, the evidence still needed and the steps before your visa expires. Keep the response with your immigration records.
