Visa Condition 8503: No Further Stay and Waiver Rules Explained
Condition 8503 is commonly called a No Further Stay condition. While it operates, it restricts a visa holder from being granted most substantive visas while the holder remains in Australia, subject to the exceptions and waiver provisions in Australian migration law.
What does condition 8503 do?
Schedule 8 of the Migration Regulations 1994 states that a holder subject to condition 8503 will not, after entering Australia, be entitled to be granted a substantive visa other than a protection visa while remaining in Australia. Other legislation can create specific exceptions or waiver circumstances.
Can condition 8503 be waived?
A waiver is possible only in circumstances permitted by the Migration Regulations. The general waiver framework includes compelling and compassionate circumstances that developed after the visa was granted, were beyond the visa holder's control and resulted in a major change to the holder's circumstances. If an earlier waiver request was refused, the legislation also addresses the need for substantially different circumstances for a later request.
There are also additional statutory circumstances relating to specified visa pathways. Because the waiver framework is technical and can change, applicants should check the current version of regulation 2.05 and obtain advice where the outcome matters to another visa application.
How to request a No Further Stay waiver
Home Affairs provides an online No Further Stay waiver request form for a person who is in Australia, has a No Further Stay condition on the current or most recently held visa and wants to apply for another visa to remain in Australia.
A waiver is not automatic
The existence of a waiver process does not mean the Department must waive the condition. Home Affairs' Form 1447 also states that a decision not to waive a No Further Stay condition is not reviewable by the Administrative Review Tribunal or another Department office. A later waiver request requires new and substantially different reasons from those in the previous request.
How to check whether 8503 applies
Do not assume that a visa subclass automatically has or does not have condition 8503. Check the visa grant letter and VEVO. Home Affairs states that VEVO shows the conditions attached to the current in-effect visa.
