Visa Condition 8202: Student Course Requirements, Progress and Attendance
Visa condition 8202 is a core Student visa study condition. It requires relevant visa holders to maintain the enrolment and academic requirements prescribed by Schedule 8 of the Migration Regulations 1994.
What does condition 8202 require?
Home Affairs summarises condition 8202 as requiring the visa holder to remain enrolled in the required registered course, maintain an appropriate level of study and maintain satisfactory attendance and course progress as required by the education provider.
Full-time enrolment and registered courses
For most holders covered by condition 8202, the legislation requires enrolment in a full-time registered course. A registered course is a course registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS). Special rules apply to Defence students, Foreign Affairs students and secondary exchange students.
Changing course or AQF level
Condition 8202 also regulates course changes. Home Affairs states that a Student visa holder must generally maintain enrolment in a registered course at the same Australian Qualifications Framework level, or a higher level, than the course for which the Student visa was granted, subject to the exceptions in the legislation, including the specified AQF level 10 to level 9 situation.
Course progress and attendance
The condition requires satisfactory course progress and, where applicable, satisfactory attendance. Education providers have reporting obligations under the international education framework, and a reported failure can have migration consequences.
Course gaps
Home Affairs says course gaps generally should not exceed two months, with exceptions including an end-of-academic-year study break, provider default, or where a student has completed a course and is applying for a new visa.
