Partner Visa Sponsorship Limitations Australia 2026: Two Sponsorships, 5-Year Rule and Exceptions

Australian Partner visa sponsorship is subject to numerical and timing limits. Regulation 1.20J of the Migration Regulations 1994 generally prevents approval of a new Partner or Prospective Marriage sponsorship where the sponsor has exceeded the permitted sponsorship history or the relevant five-year period has not elapsed.


The two-sponsorship limit

The regulation generally requires that no more than one other person has previously been granted a relevant permission as the sponsor's spouse, de facto partner or prospective spouse on the basis of sponsorship or nomination. In practical terms, this is commonly described as a lifetime limit of two successful Partner or Prospective Marriage sponsorships, subject to the regulation's detailed counting rules and exceptions.


The five-year rule

Where a previous person received the relevant permission through the sponsor, at least five years generally must have passed since the application for that earlier permission. A separate five-year restriction can also apply where the proposed sponsor was themselves previously granted a relevant permission as another person's spouse, de facto partner or prospective spouse.


Compelling circumstances can matter

Regulation 1.20J contains a discretion allowing sponsorship approval despite the ordinary limitations if the Minister is satisfied that there are compelling circumstances affecting the sponsor. This is not an automatic waiver and the evidence should address the actual circumstances relied upon.


Why sponsorship history should be checked early

A sponsor's past immigration history can materially alter the strategy for a Partner visa case. Couples should identify previous sponsorships, previous Partner or Prospective Marriage visas and the exact dates of earlier applications before lodging.
